VIIO credit card use agreement

These are the terms and conditions for the use of the credit card offered by VIIO (Persimon S.A.S., VIIO Colombia) to registered users. VIIO is a platform that allows you to hold an account in different currencies based on Digital Assets for Latin America. Through technology, we offer easy access from your mobile phone to an account and credit card.

The “dollars” available in VIIO refer to USDC and USDT, a Digital Asset referenced 1:1 to the United States dollar.
If you have any comment, question, or complaint, you may contact us through our customer service channels or by sending an email to soporte@viio.me.
a) This is a loan agreement (contrato de mutuo) under which VIIO, using its own resources, will grant you credit; and
b) You grant a mandate without representation to VIIO so that it may pay, on your behalf, for the products and services you obtain with your Card.
a) You are of legal age;
b) We process your personal data in accordance with our Terms and Conditions and our Privacy Policy;
c) We consult and report your credit information to credit bureaus (centrales de riesgo); and
d) We contact you through any means for the purpose of consulting or informing you about any matter related to your Card.
a) Update your information at least once a year;
b) Submit any information requested by VIIO; and
c) Contact us immediately in the event of fraud, theft, or loss of your Card.
VIIO will deliver your Card, physical or virtual, deactivated. You may activate it through the mobile application whenever you wish. It:
a) Will have unique identification digits, an expiration date, the brand holder, a security code, an integrated circuit, and a security key, among others;
b) Is personal and non-transferable; and
c) Is used to pay for products and services at physical establishments or online merchants.
a) VIIO will grant you credit up to an amount equivalent to the value of the Digital Assets held in your VIIO account;
b) When you make a purchase, VIIO will make the payment as a loan. It will then deduct from your account the Digital Assets equivalent to the value of your purchase, to pay off that loan (or mutuo agreement).
The Card currently does not charge interest.
The Card currently does not charge any fee.
a) Yes — if you enter the incorrect PIN three times in a row, the Card will be blocked and you will need us to send you a new one or contact us;
b) You may block the card whenever you wish through the application. We ask that you use this function immediately in the event of fraud, theft, or loss; and
c) VIIO may block your Card if you fail to comply with these terms and conditions.
Every time you make a payment, you will receive a VIIO transaction receipt identifying the transaction number, the amount, the time, and the date.
You may exercise your right of withdrawal after submitting your request to receive the Card, while it is still pending assignment or dispatch. You may exercise this right for five (5) business days after your request.

If you use the Card, you may no longer exercise this right.
A Reversal is the right a Customer has to reverse a purchase made through a Payment Channel via e-commerce mechanisms, in the following events:
i) When there is fraud in the purchase;
ii) When you did not authorize the purchase; and
iii) When the good or service was not delivered, does not match what was purchased, is defective, or its quality does not match the Merchant's description.

In these cases, the Customer has five (5) business days from the date they become aware of any of the above events to request the Reversal, and VIIO will proceed in accordance with the terms of Article 51 of the Consumer Protection Statute and other applicable rules.
We may modify this contract and its conditions through a written document. We will notify you of these modifications through notices and alerts. If you do not agree with the modifications, you may request termination of the contract, without any liability, provided you pay the full amount of any credit you owe to VIIO.
a) VIIO may assign this contract without consent and without prior notice; and
b) You may not assign this contract without VIIO's written consent.
This contract is governed by Colombian law.
VIIO commits to making its best efforts to ensure the availability, continuity, and proper functioning of the application. However, in the event that, for reasons beyond our control, the application service or communication channels (including those of the financial system) are temporarily or permanently interrupted, no claim may be made against VIIO, nor will any right to compensation arise in favor of users.
a) VIIO does not directly or indirectly collect funds from the public, does not provide investment services, and does not offer advice for the purchase or sale of Digital Assets, stablecoins, currencies, or any other type of asset;
b) VIIO is not the issuer of the referenced Digital Assets. At no time does it carry out purchase, sale, or exchange operations with currencies, nor does it receive or manage users' money.
